A Federal High Court in Abuja has ruled that the leadership of the African Democratic Congress (ADC) was illegally constituted, effectively voiding the presidential nomination of Atiku Abubakar. The ruling comes just two months before Nigeria’s presidential election, scheduled for January 16. This judicial intervention creates significant uncertainty for Abubakar’s seventh bid for the presidency as he seeks to challenge the incumbent, President Bola Tinubu, and the Labour Party’s Peter Obi.
The court’s decision found that the ADC's leadership structure was not properly formed under the party's internal regulations. In response, the ADC, which has maintained its leadership under David Mark, announced its intention to appeal the verdict. Party spokesperson Bolaji Abdullahi described the ruling as a "desperate attempt" to undermine the opposition and infringe upon the democratic rights of Nigerians. The party further alleged interference from the ruling All Progressives Congress (APC), a claim the APC has denied, describing the matter as an internal ADC dispute.
Despite the legal setback, Atiku Abubakar has urged his supporters to remain focused, affirming his determination to stay in the race. He criticized the current administration, accusing it of attempting to transition Nigeria into a one-party state by using the judiciary to eliminate viable challengers. Fellow opposition candidate Peter Obi also expressed concern, describing the court’s ruling as "shocking" and emphasizing the need for stability in the electoral process to protect Nigeria's democracy.
The voiding of Abubakar’s nomination introduces a high-stakes legal battle into an already tense political environment. If the appeal is unsuccessful, the absence of a major candidate with significant regional influence could fundamentally alter the electoral landscape. As the January 16 deadline approaches, the Nigerian judiciary remains under intense scrutiny to resolve these leadership disputes and clarify the final list of eligible candidates before voters head to the polls.
